Terms of Use


This Terms of Use (hereinafter referred to as "this Agreement") sets forth the terms and conditions of use of the online shop (hereinafter referred to as "this Service") provided by STORNG (hereinafter referred to as "the Company") on this website. Users (hereinafter referred to as "Users") are requested to use this Service in accordance with this Agreement.

Article 1 Scope of Application

This Agreement shall apply to all matters relating to the use of this Service between the User and the Company.
The Company may establish rules, etc., and various provisions (hereinafter referred to as "Individual Provisions") concerning the use of this Service in addition to this Agreement. Regardless of their name, these Individual Provisions shall constitute a part of this Agreement.
In the event of any conflict between the provisions of this Agreement and the provisions of the Individual Provisions in the preceding paragraph, unless otherwise specified in the Individual Provisions, the provisions of the Individual Provisions shall prevail.

 

Article 2 User Registration

In this Service, a person who wishes to register shall apply for registration by agreeing to this Agreement and following the method prescribed by the Company, and the registration shall be completed when the Company notifies the applicant for registration of its approval.
The Company may not approve the registration application if it determines that the applicant for registration falls under any of the following reasons, and shall not be obliged to disclose the reasons:
- The applicant for registration has been subject to the cancellation of membership registration due to violation of the terms and conditions of any service provided by the Company.
- The registration application contains false information.
- There has been a delay in the performance of payment obligations such as fees related to products or services (hereinafter referred to as "Products, etc.").
- The User has engaged in acts prohibited under Article 6 of this Agreement.
- Any other violation of this Agreement.

 

Article 3 Management of User ID and Password

The User shall be responsible for managing his/her user ID and password for this Service at his/her own risk.
In any case, the User may not transfer or lend his/her user ID and password to a third party, or share them with a third party. If the combination of the user ID and password matches the registration information and is logged in, the Company will regard it as the use by the User who registered the user ID.
The Company shall not be liable for any damages caused by the use of the user ID and password by a third party.

 

Article 4 Sales Contract

In this Service, a sales contract shall be concluded when the User applies for purchase to the Company and the Company notifies the User of the acceptance of the application. Ownership of the product shall be transferred to the User when the Company delivers the product to the delivery company.
The Company may revoke the sales contract under the preceding paragraph without prior notice to the User if the User falls under any of the following reasons:
- The User has violated this Agreement.
- Delivery of the product cannot be completed due to unknown delivery destination or long-term absence.
- Any other case where the trust relationship between the Company and the User has been impaired.
Payment methods, delivery methods, cancellation methods for purchase applications, and return methods regarding this Service shall be determined separately by the Company.

 

Article 5 Intellectual Property Rights

The copyright and other intellectual property rights of any content (text, illustrations, designs, photographs, images, logos, icons, videos, programs, etc.) provided by this Service (hereinafter referred to as "Content") shall belong to legitimate rights holders such as the Company and content providers, and Users shall not reproduce, reprint, modify, or otherwise use the Content without permission.
If a problem arises between the User and a third party due to a violation of the provisions of this Article, the User shall resolve the problem at his/her own responsibility and expense and shall not cause any damage, loss, or disadvantage to the Company.

 

Article 6 Prohibited Acts

Users shall not engage in the following acts when using this Service:

- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that infringe copyrights, trademark rights, or other intellectual property rights contained in this Service.
- Acts that destroy or interfere with the functions of the Company's servers or networks.
- Commercial use of information obtained through this Service.
- Acts that may interfere with the operation of the Company's services.
- Unauthorized access or attempted unauthorized access.
- Collection or accumulation of personal information, etc., of other Users.
- Acts of impersonating other Users.
- Acts that directly or indirectly provide benefits to antisocial forces in connection with this Service.
- Any other acts deemed inappropriate by the Company.

 

Article 7 Suspension of Service Provision, etc.

The Company may suspend or interrupt all or part of the provision of this Service without prior notice to the User if the Company determines that any of the following reasons exist:
- When maintenance, inspection, or updating of the computer system for this Service is performed.
- When it becomes difficult to provide this Service due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters.
- When the computer or communication line, etc., is stopped due to an accident.
- Any other case where the Company deems it difficult to provide this Service.
The Company shall not be liable for any damages or losses incurred by the User or a third party due to the suspension or interruption of the provision of this Service, regardless of the reason.

 

Article 8 Restriction of Use and Deletion of Registration

The Company may, without prior notice, restrict the use of all or part of this Service or delete the registration of a User if any of the following applies:
- Violation of any provision of this Agreement.
- If it is found that there is false information in the registered information.
- When the credit card registered by the User as a payment method becomes unusable.
- If there is a delay in the payment obligations such as fees.
- When there is no response for a certain period to the communication from the Company.
- When there is no use for a certain period after the last use regarding this Service.
- Any other case where the Company deems the use of this Service inappropriate.
The Company shall not be liable for any damages caused to the User by any action taken by the Company under this Article.

 

Article 9 Withdrawal

The User may withdraw from this Service by following the prescribed withdrawal procedure.

Article 10 Disclaimer and Exemption Clause

The Company does not guarantee that this Service is free from defects (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc.) in fact or law.
The Company shall not be liable for any damages caused to the User by the use of this Service. However, if the contract regarding this Service between the Company and the User (including this Agreement) falls under a consumer contract under the Consumer Contract Act, this disclaimer provision shall not apply. Even in this case, however, the Company shall not be liable for any damages caused to the User by the Company's negligence (excluding gross negligence) or by tort, except for special circumstances of damages caused by the Company's negligence (including cases where the Company or the User could foresee or foresee the occurrence of damages).
The Company shall not be liable for any transaction, communication, or dispute, etc., between the User and other Users or third parties in connection with this Service.

 

Article 11 Change of Service Content, etc.

The Company may change the content of this Service or suspend or discontinue the provision of this Service without notifying the User. The Company shall not be liable for any damages caused to the User due to any change, suspension, or discontinuation of the provision of this Service.

 

Article 12 Amendment of Terms and Conditions

The Company may amend this Agreement at any time without prior notice to the User if deemed necessary. However, if the User starts using this Service after the amendment of this Agreement, it shall be deemed that the User has agreed to the amended terms and conditions.

 

Article 13 Handling of Personal Information

The Company shall handle personal information obtained through the use of this Service appropriately in accordance with the Company's "Privacy Policy".

 

Article 14 Notice or Contact

Notifications or contacts between the User and the Company shall be made by the method specified by the Company. Unless otherwise specified by the Company, the Company shall send notifications or contacts to the currently registered contact point as valid at the time of dispatch, and these shall be deemed to have reached the User at the time of dispatch.

 

Article 15 Prohibition of Assignment of Rights and Obligations

The User may not assign or pledge to a third party any rights or obligations under the usage agreement or this Agreement without the prior written consent of the Company.

 

Article 16 Governing Law and Jurisdiction

Japanese law shall govern the interpretation of this Agreement. However, regarding this Service, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded.
In the event of a dispute regarding this Service, the exclusive jurisdictional court shall be the court having jurisdiction over the location of the Company's principal office.
